Daughter Injured Defective Pool Flotation DeviceFrom: Christy
Category: Dangerous Products Defective
My daughter was injured by a defective pool flotation device in Dec07. Injury was severe on inner thigh, lasted for weeks. We were in Disney on vacation and vacation was ruined, she had difficulty swimming, walking, urinating and couldn't wear underwear for weeks. She has permanent scar on inner thigh (no plastic surgery needed) we filled our report at store where vest was purchased, and manufacturer called us asking us
a lot of questions. Would like to know if we have any kind of case. Thank you for your time.

CommentsProducts liability actions are generally more complex than motor vehicle accidents or premises liability accidents otherwise known as slip and fall accidents or
trip and fall accidents.
There are several types of products liability causes of action including: design defect, manufacturing defect, failure to warn/improper labeling and strict liability.
Due to the complexity and correlating expense of defective product cases, the personal injuries underpinning the personal injury lawsuit must be serious injuries, that warrant significant money damages.
Another factor that complicates many personal injury lawsuits based on products liability claims is the difficulty of obtaining
jurisdiction, in New York, over the manufacturer or re-seller of the dangerous or defective product.
As always, this does not constitute legal advice, only a brief summary of the broad legal issues which may be involved in a personal injury claim in New York.
