I fell on a construction site. Both my back and neck were injured. I was able to collect comp for about 6mo. -1 yr. This was in 1980. My condition has worsened. What are my options?

In New York, the statute of limitations on a construction site personal injury action, and most other types of negligence lawsuits, is three years, measured from the date of the accident. This means that, barring extraordinary circumstances such as mental incapacity or infancy (being under the age of 18) you have to bring a personal injury lawsuit within three years of the date the accident occurred. Please remember that this does not constitute specific legal advice, just a brief overview of relevant New York law as it applies to negligence and/or medical malpractice. It is not intended to create a lawyer client relationship and should not be relied upon without further consultation. Regards: Paul Ajlouny, Esq.
