I was involved in an accident with my girlfriend car. Her car was totaled. She purchased the car from Hudson Toyota in New Jersey. At the time she was with a friend of the family. She did him a favor out of good faith by using her perfect credit to get him a car. He was ordered by the dealership to get insurance on the brand new car. He did not get full coverage on the brand new car. This all happened in Sept. It is now March 15th the car accident happened February 30th. If there was insurance on the car both front & gap insurance she should have had a brand new car by now. That is not the case. He lied and told her there was insurance on the car. We found out there was no insurance on the car since November. What should she do in a case like this. Please call

This is a property damage and possibly a breach of contract claim. It is impossible for me to render an opinion based on the description you have provided but, it is the responsibility of the owner of the vehicle to make sure it is insured. Also, New York State will not register a vehicle without proof of insurance.
