I was a passenger in my friends that was in an accident - besides going after the car that hit us - can I go after my friends insurance company.

If the driver of the car you were in was at fault in the accident, and more than one driver can be at fault, then you can bring a personal injury action against him in New York as well as the other driver. In most cases, a rear end collision is automatically the fault of the following driver. However, if it was a minor collision and you did not suffer what the law considers to be a "serious injury" New York personal injury law limits your right to recovery would be limited to your "no fault" benefits, i.e. medical bills and lost wages up to fifty thousand dollars.
