People who are injured in pedestrian car accidents can only maintain a successful New York personal injury claim if they suffer what the law defines as "a serious injury". However, in order to be compensated for medical expenses and lost wages, a person injured in any type of New York car accident must notify the other driver's insurance company as well as the insurer for any vehicles owned by a family member who lives in the same household. The application for these benefits must be filed within 30 days of the car accident under New York personal injury law. Please remember that this is not specific legal advice.
