New York law limits damages in wrongful death cases to economic damages and conscious pain and suffering before death. In many instances, the economic value of the claim on behalf of the estate of a construction worker can be quite high, especially if the worker was a union member. The value of the conscious pain and suffering aspect is determined by the amount of time, the nature of the injuries and, whether the victim knew he was dying. Without knowing the details as to how much the victim was earning, how old he was and several other important factors, I cannot offer an opinion as to the value of the case.
