In order to bring a successful personal injury lawsuit, you need three things: fault, injuries and insurance coverage or other assets on the part of the defendant.
You may also be able to recover under the uninsured/supplemental underinsured motorist provisions of your own automobile insurance policy. This type of coverage is now mandated in New York.
